APNU+AFC elections petition destine for failure -AG Nandlall

The APNU+AFC Opposition’s petition challenging the outcome of the March 2, 2020 General and Regional elections has no chance of succeeding in the court, so says Attorney General and Minister of Legal Affairs, Hon. Mohabir Anil Nandlall.

The Attorney General was at the time appearing on NCN’s television programme ‘Insight’. The AG explained that based on the excerpts he has read in the press, the petition is based on unproven claims and as such “is destine for failure.”

“They based their petition on, the same ridiculous, outrageous, unsubstantiated contentions and accusations that they were making at the [Arthur Chung] Convention Centre…that petition has no likelihood of success.”

In addition, the Attorney General pointed out that missing from the APNU+AFC Opposition’s petition is their Statements of Poll (SOPs).

“The basis of any elections is the Statement of Poll. You are going to a court to ask a judge to set aside a whole election; put a government out of office; set aside that political party and you are not putting forward your results,” the AG noted.

The Attorney General said the advantage of the petition is that it will now allow for full disclosure of all the unethical issues of the APNU+AFC surrounding the March 2, 2020 General and Regional elections.

“The case lacks morale underpinning, it lacks a morale foundation and all that which they have been avoiding and that which their agents are hiding at GECOM, all will come out now in the court,”he added.

AG Nandlall  explained that the courts will order both the APNU+AFC Opposition and GECOM to produce their SOPs.

The filing of the election petition has one advantage, it gives the PPP/C government the opportunity to put staff of GECOM and members of the APNU+AFC Opposition in a witness box.

 “Former Health Minister Volda Lawrence will have to tell the court under oath how her signature is on a declaration made by Region Four Returning Officer Clairmont Mingo,” the AG pointed out.

The Legal Affairs Minister noted that this is what the now government had always wanted, redress for the March 2, 2020 General and Regional elections fraud, but through the right channel.
