According to a statement from the GPF, the sentence falls under the Public Health Ordinance.

The statement said that the act by Gardner was a “breach of restriction to home, in contravention of No.1 Restriction of the COVID-19 Emergency Measures #53/2020, contrary to Section 21 (2) of the Public Health Ordinance, Chapter 145.”

The curfew restricts persons from being out of their home between 6pm and 6am until May 3 to help slow the spread of the coronavirus.

The emergency measures were outlined and implemented by the Ministry of Public Health under the directions of His excellency President David Granger.

It is outlined in the emergency orders if a person fails to comply with any of these measures he/she will have committed an offence under Section 152 of the Public Health Ordinance and is liable on summary conviction to the penalty provided under that section.
